The Official Gazette published details of the organization of the National Center for Government Resource Systems, which specializes in providing administrative, advisory, and project management services for government agencies. To enable them to use government resource systems.
aFor the first article: The following words and expressions – wherever they appear in this regulation – will have the meanings indicated next to each of them:
Center: The National Center for Government Resource Systems.
Organization: Organization of the center.
Minister: Minister of Finance.
Council: The Centre’s Board of Directors.
President: Chairman of the Council.
CEO: The CEO of the Centre.
Unified System: Unified System for Government Resources (UGRP).
Government resources systems: electronic financial and administrative systems for government resources, which serve government agencies, individuals, and private sector entities dealing with those entities. These systems include: the unified system, and other electronic systems related to finance, accounts, the state’s general budget, government payments, government competitions and purchases, supplier relations and supply chains, government asset and warehouse management systems, billing and collection of government revenues, human resources systems, personnel affairs, payroll, and self-services for leave requests and tasks. Work, training, transportation, and the like.
Governmental entities:
Entities covered by the state’s general budget, entities covered by the application of the government competition and procurement system, and those covered by the application of the state revenue system and any regulations issued regarding government resource systems.
Technical operation:
Daily technical maintenance and operation of government resource systems, which includes: updating and upgrading the software and technical hardware that make up those systems, fixing faults, monitoring performance, and providing technical support to users of those systems.
second subject: The Center has legal personality and financial and administrative independence. It is linked – organizationally – to the Minister, and its main headquarters is in the city of Riyadh. It has the right to establish branches or offices within the Kingdom as needed.
Article Three: The center aims to:
1- Providing standard and unified electronic systems for managing government resources, supporting the integration, unification and improvement of procedures between government agencies, and supporting decision-making processes by improving the quality of data and reports, in coordination with the concerned authorities.
2- Contributing to supporting government agencies in planning and managing their financial and human resources and supply chains efficiently and effectively.
3- Working to achieve spending efficiency by reducing the repetition of building and operating government resource systems in government agencies.
4- Contributing to unifying controls, standards and procedures related to government resource systems in government agencies, providing flexibility and speed in responding to requests for change to those systems, and measuring and analyzing the expected impact of those requests.
5- Contributing to achieving transparency, discovering and reducing errors and violations, and raising the level of integrity and accuracy of data and reports for audit and control processes.
Article Four: Without prejudice to the powers of the relevant authorities, the Center shall assume the following powers and tasks:
1- Developing policies, strategies, plans and programs related to government resource systems and their governance, in coordination with the relevant authorities, and completing what is necessary in this regard.
2- Managing and governing government resource systems data and utilizing them to achieve the center’s objectives, and developing the necessary policies and procedures to determine the powers of the beneficiaries of that data.
3- Managing the legal identities of beneficiaries of government resource systems in accordance with the approved specifications and policies for unified national access to all electronic government portals and services.
4- Benefiting from the data that the Center produces, or collects from beneficiaries of government resource systems, including, but not limited to: data processing, storage, and analysis, in order to achieve the Center’s strategic objectives.
5- Managing and governing the processes of designing and developing detailed work procedures in government resource systems and continuously improving them, and setting controls and rules related to these procedures; Coordination with the relevant government agencies.
6- Management, design, development and technical operation of government resource systems.
7- Design, implement, operate and manage the infrastructure of government resource systems.
8- Providing services related to government resource systems to beneficiaries.
9- Providing reporting and information services, and analysis and forecasting models related to government resource systems, to authorized beneficiaries.
10- Establishing the necessary standards, plans and controls to enforce the application of government resource systems, in coordination with the relevant authorities, and measuring performance indicators for operations in government resource systems.
11- Providing supportive electronic services to government agencies; To manage its government resources and achieve integration of procedures and exchange of data with government agencies’ systems.
This includes the central and supporting electronic systems that the center needs to achieve its goals or have a role in raising the efficiency of spending and operation and achieving financial savings for the state.
12- Providing administrative, consulting, and project management services for government agencies; To enable them to use government resource systems.
13- Providing training and support services to beneficiaries of government resource systems.
Article Five: The Center shall have a Board of Directors headed by the Minister and membership of:
1- Director of the National Information Center.
2- Deputy Minister of Human Resources and Social Development for the Civil Service.
3- Governor of the Digital Government Authority.
4- A representative of the Ministry of Defense with excellent rank.
5- Assistant Minister of Finance for Financial Affairs.
6- CEO of the National Center for Government Resource Systems.
7- At least a representative of specialists shall be appointed by order of the Prime Minister based on a proposal from the Minister, and his membership term shall be (three) years, renewable once.
Article Six: The Council is the highest authority for the Centre. It is responsible for supervising, managing and managing its affairs. It may take the necessary decisions and actions to achieve its objectives and exercise its powers within the limits of the Centre’s powers. It may, in particular, do the following:
1- Approving the center’s general policy, work plan, and operational plans, which it follows to achieve its objectives, reviewing them, and following up on their implementation.
2- Develop appropriate policies and procedures to implement the unified system.
3- Supervising the implementation of the unified system.
4- Excluding government agencies that have independent government resource systems and have security or practical justifications, for a specific period of time; From applying the unified system to them, to keep their systems independent of it.
5- Approval of the center’s organizational structure.
6- Approving the administrative and financial regulations that the center operates, provided that the administrative regulations are approved in agreement with the Ministry of Human Resources and Social Development, and the financial regulations and provisions that have a financial impact in the administrative regulations are approved in agreement with the Ministry of Finance.
7- Approval of the financial compensation that the center charges for licenses, permits, and the work and services it provides in accordance with the regulation.
8- Approval to establish branches and offices of the center within the Kingdom.
9- Approval of the Center’s draft budget, its final accounts, the auditor’s report, and the annual report; In preparation for submitting it in accordance with the established regulatory procedures.
10- Accepting gifts, donations, grants, wills, and endowments submitted to the Center, in accordance with the established regulatory procedures.
11- Appointing one (or more) certified external auditors and an internal financial controller.
12- Approval of concluding agreements and contracts in accordance with the established legal procedures.
The Council may delegate some of its powers to the President or any of its members or employees of the Centre.
Article Seven: The Council may form permanent or temporary committees from its members or others, to which it assigns whatever tasks it deems appropriate. The decision to form each committee shall specify its chairman, members, and powers. These committees may seek assistance from whomever they deem fit to perform the tasks assigned to them.
Article Eight:
1- Council meetings are held at the Center’s headquarters under the chairmanship of the President or a representative of the government agencies that are members of the Council. They may, when necessary, be held in another location within the Kingdom.
2- The Council meets – upon the invitation of the President – once every (three) months, and whenever the need arises according to the President’s discretion. The President must call the Council to a meeting if at least half of the members request this. The invitation must be sent – in writing – at least (seven) days before the meeting, provided that the invitation includes the meeting agenda.
3- The Council meeting is not considered valid unless attended by at least a majority of the members, including the Chairman or his representative from among the representatives of government agencies that are members of the Council.
4- The Council’s decisions shall be issued by a majority of the votes of the members present, and in the event of equal votes, the side with which the Chairman of the meeting voted shall prevail.
5- Council meetings may be held remotely, through the use of technical means. Decisions can be made by passing them on to the members, and they sign them indicating that they are informed of them. Decisions taken in this way are not considered valid unless all members vote on them and are approved by at least two-thirds of the members. The decisions taken in this way are presented to the Council at the first – and subsequent – meeting to be recorded in the minutes of the meeting.
6- The Council’s deliberations and decisions are recorded in minutes signed by the chairman of the meeting and the attending members, and the objecting member has the right to record his objection with reasons in the minutes.
7- No member of the Council may abstain from voting, nor authorize another member to vote on his behalf in his absence.
8- The Council may invite whomever it sees fit among the specialists and advisors – whether from inside or outside the Kingdom – to attend its meetings and seek their assistance, without them having the right to vote.
9- The Secretary of the Council is responsible for preparing for the Council’s meetings, informing its members of their dates, preparing its minutes and decisions, and any tasks assigned to him by the Council or the President.
Article Nine: The center will have an executive president who will be appointed and relieved from his position by a decision of the council, in which his remuneration and other financial benefits will be determined. He is responsible for managing the center and its daily work, and he may, in particular, exercise the following powers:
1- Supervising the center’s work progress through approved regulations, plans and programmes.
2- Proposing the center’s general policies, its work plan, and operational plans, submitting them to the Council, and following up on their implementation after their approval.
3- Proposing the structure of the organizational center and its administrative and financial regulations, and submitting them to the Council for approval.
4- Issuing the necessary decisions to implement what is required by the approved organization, regulations, rules and procedures, according to the powers delegated to him.
5- Supervising the preparation of the Center’s draft budget, its draft final account, and its annual report, in preparation for presenting it to the Council.
6- Appointing the center’s workers in accordance with what is specified by the center’s regulations, and supervising them.
7- Contracting with experts, consultants, and think tanks from inside or outside the Kingdom to serve the Center’s objectives and competencies, in accordance with what is determined by the Center’s regulations and the legal procedures followed.
8- Signing agreements, memorandums of understanding, contracts and other documents, after the approval of the Council and in accordance with the established legal procedures.
9- Representing the Center before the judicial and administrative authorities and other authorities inside and outside the Kingdom, and it may authorize others to do so.
10- Disbursing from the Center’s budget, and taking all financial measures, in accordance with the approved rules and regulations, and within the limits of the powers delegated to it by the Council.
11- Submitting periodic reports to the Council on the Centre’s work, achievements and activities, the challenges it faces, and the proposals it deems appropriate to improve the workflow.
12- Other powers or powers assigned to him by the Council.
The CEO may delegate some of his powers and powers to whomever he deems appropriate among the center’s employees, in accordance with what is determined by the center’s regulations.
Article 10:
1- The center shall have an independent annual budget.
2- The center’s fiscal year is the state’s fiscal year.
Article Eleven:
1- The center’s financial resources consist of the following:
A- What is allocated to it in the state’s general budget.
B- The financial compensation that the center receives for licenses, permits, and the work and services it provides.
C- Gifts, donations, grants, wills and endowments accepted by the Council.
D- Any other resource approved by the Council that does not violate regulations and instructions.
2- All of the Center’s revenues are deposited in the Ministry of Finance’s current account with the Central Bank of Saudi Arabia.
3- The Center opens an account in the Central Bank of Saudi Arabia, and may open other accounts in any of the banks licensed to operate in the Kingdom, and disbursements from these accounts are made from the Center’s approved budget in accordance with its financial and administrative regulations.
aArticle Twelve: The center’s employees are subject to the provisions of the labor system and the social insurance system.
Article Thirteen: Without prejudice to the jurisdiction of the General Court of Accounts, the Council appoints an external auditor (or more) who are licensed to work in the Kingdom, to audit the center’s accounts, transactions, data, annual budget, and final account. The Council determines its fees, submits the auditor’s report to the Council, and then provides the General Court For accounting, a copy thereof.
Article Fourteen: The organization replaces the organizational arrangements for the National Center for Government Resources Systems, issued by Cabinet Resolution No. (682) dated 11/19/1442 AH.
Article fifteen: The regulation shall be published in the Official Gazette, and shall be effective from the date of its publication.
