Instructions The civil service regarding the transfer of employees and the government vacancy system “Vacancies” First: Objective: These instructions aim to: 1- State the procedures for transferring employees from one job to another in the same government agency or to another government agency, and state the rules for determining salaries and job benefits upon transfer. 2- Establish an electronic service that allows government agencies to internally announce vacancies in the civil service through the government vacancy system “Vacancies,” and then apply for them by civil service employees via the electronic portal of the civil service agency or the “Government Employee” application. Second: Policy: 1- Investing human competencies in jobs that suit their qualifications, experience, and skills, in a way that achieves growth and job satisfaction for employees and raises the level of services provided by government agencies, by establishing a clear mechanism for selecting and attracting the most appropriate competencies, taking into account the interest of employees transferred from one job to another in the same government agency, or in another government agency, in accordance with the provisions of these instructions. 2- Preserving national competencies, encouraging opportunities for advancement and career development, consolidating the principle of justice and equal opportunities, creating a spirit of competition, and strengthening the principle Transparency and increasing productivity by giving civil service employees who wish to have the opportunity to apply for vacant positions in government agencies internally. Third: Definitions: 1- Transfer: Transferring an employee from the job he holds to another job classified at a level equivalent to or higher than the job level he occupies within the government agency in which he works or to another government agency subject to the provisions of the Civil Service Law. 2- Government vacancy system “Vacancies”: A system of a special nature that allows government agencies to announce internally the vacant positions they have for civil service employees and then apply. It can be granted by employees wishing to it through the electronic portal of the Civil Service Authority or the “Government Employee” application. Fourth: Transferring employees A – Responsibilities: 1- The Civil Service Authority: Reviews employee transfer requests, and is responsible for approving them after ensuring that they meet the transfer controls and requirements contained in these instructions, and the conditions for filling the position to which the employee is requested to be transferred. 2- Government agencies: Implement the provisions contained in these instructions and ensure that the nominated employees fulfill the transfer controls and requirements contained in these instructions, and the conditions for filling the position to which the employee is requested to be transferred before sending transfer requests to the agency. Civil Service. B – Transfer controls and conditions: 1- That the employee fulfills the conditions for filling the position to which he is transferred, which are determined by the job evaluation system, standards and job descriptions issued by the Civil Service Authority. 2- The level of the employee’s job performance – according to his last evaluation – should not be less than a rating that fully meets expectations, when transferred to a job whose grade is higher than that of the position he occupies. 3- That the job to which the employee is transferred is based on the organizational structure and vacant, has financial approval, and is within the maximum number of positions if The transfer was to another government agency. 4- Career progression should be taken into account when transferring from one job to another. 5- The transfer must be in the public interest. 6- The grade of the job to which the employee is transferred should not be lower than the grade of the job he holds. 7- The transfer within the government agency must be by decision of the competent authority after the approval of the civil service agency. The grade of the position he holds before one year has passed from the date of his appointment, with the exception of the case of his transfer because he has obtained the academic qualification required to fill the position to which he is transferred. C – Transfer procedures: 1- Government agencies send transfer requests approved by the competent authority through the electronic work flow system (Work Flow), attaching all the required documents. 2- The Civil Service Agency reviews and approves transfer requests that meet the controls, conditions and standards and approves them in the management information system for human resources. D – Determining the salary and job benefits upon transfer: 1- When an employee is transferred from one job to another job located in the same job group, he retains his grade and the rank he holds, and is given the basic salary for this grade and rank according to the grades and salaries schedule with the regular working hours system (36 hours per week) or the grades and salaries schedule with the extended working hours system or shifts (40 working hours per week), according to what is required by the job to which the employee is transferred. 2- When the employee is transferred from one job to another suitable job In another job group, the job grade equivalent to the grade he holds is determined in accordance with the grade equivalency table approved in the civil service, and the basic salary is determined according to the basic salaries of the grade equivalent to his current basic salary, as follows: A – If the employee’s basic salary rate before the transfer is equal to the basic salary rate in one of the grade ranks of the position he is transferred to, then the employee is granted this rank. B – If the employee’s basic salary rate falls between two ranks, he is granted the higher rank. C – If the basic salary is For a job held that is higher than the basic salary for the end of the equivalent grade, the salary is equalized to the next grade, and if the employee’s transfer approves a promotion, he is granted a promotion of two ranks at the same current grade, according to the payroll with the regular working hours system (36 hours per week) or the payroll with the extended working hours system or shifts (40 working hours per week) according to what is required by the job to which the employee is transferred. 3- It is permissible to adjust the employee’s salary for a shift-based job for someone who has spent two years working in shifts. Continuous, without interruption, even if the job to which he is transferred does not require shift work. 4- The transfer may not result in a reduction in the employee’s salary, provided that it is within the same working hours system. 5- The job benefits granted to the employee before the transfer are adjusted to the job benefits due to the job to which he is transferred. The average salary between two ranks gives the higher rank. E – General provisions: 1- When transferring, the employee may be promoted if he meets the standards, rules and conditions of promotion in accordance with the promotion instructions. 2- When transferring to public and executive positions, long years of experience in the field of the job to which the employee is requested to be transferred can be taken into account, in the event that he does not obtain the required academic qualification according to the estimates of the competent authority and the approval of the civil service apparatus. This does not apply to jobs that require obtaining professional licenses to perform the tasks of these jobs. 3- The employee shall retain the balance of leave due to him when transferred from one government entity to another government entity, and he may not be granted cash compensation for the balance of annual leave. Fifth: The government vacancy system “Vacancies”: A – Responsibilities: 1- The Civil Service Authority: A) Providing opinion and technical advice and training specialists in human resources in government agencies regarding the government vacancy system “Vacancies.” B) Providing the job advertisement service 2- Government agencies: a) Notify the civil service agency of the positions to be filled, and ensure that job vacancies exist in the organizational structure and within the maximum number of positions. b) Submit documents proving the fulfillment of the conditions stipulated in the law and regulations of the civil service. c) Review applications and ensure that the chosen candidate fulfills the controls and criteria for filling the announced position before sending Application for the Civil Service Agency. D) Updating the advertisements in the system within a period not exceeding two weeks from the end of the application display period. 3- The employee: A) Submitting the application through the government vacancy system “Shawager” through the electronic portal of the Civil Service Authority or the “Government Employee” application and completing all its requirements. B) Adhering to the terms and requirements of the announced vacancy and adhering to submitting the correct documents, data and information when submitting the application. Through the government vacancy system “Shawager” after confirming the existence of the job vacancy and financial approval, taking into account the notes contained in the approved organizational structure, and attaching the required documents for each position. 2- The announcement of vacant positions in the system shall be according to the maximum number of positions for the government entity. 3- The announcement shall be published in the system for a period of 21 days, or as determined by the civil service agency. 4- The applicant must attach his CV and academic qualifications, and attaching incorrect data related to the CV or documents related to academic qualifications is considered a violation. It must be held disciplinary accountable. 5- Submitting the application through “Vacancies” is considered an acknowledgment of approval of the transfer to the announced vacant position, and the employee may withdraw from the transfer before approving it in the acceptance form to fill a position through the government vacancy system “Vacancies” attached to this decision. 6- Government agencies receive a list of applicants in the system, prepare the necessary interviews and select the appropriate candidate who meets the conditions and controls for filling the position, in accordance with the civil service law and regulations, within one month from the date of receiving the list of applicants. 7- The entity must The government agency must complete the interview procedures and select suitable candidates for the completed advertisements before starting to advertise other jobs, provided that the maximum number of positions in the entity submitting the application is taken into account. 8- The government entity sends the transfer request to the selected employee attached to the job procedure form 52 approved by the competent authority and an acceptance form to fill a position through the government vacancy system “Vacancies” attached to this decision. When submitting the transfer request, the government entity must specify its effective date, provided that it is from the beginning of the month, and the period must not be less than a month and not more than one month. For two months. The government agency to which the transferred employee belongs may request a postponement of the implementation of the transfer for reasons required by the interest of the work for a period of one month, or after the end of the semester in the case of transferring the occupants of teachers’ positions and first teachers to other government agencies, subject to the approval of the civil service agency.
