She added that the legal profession, from the perspective of the collective group, is a noble message before it is a profession, because of the values ​​it carries of defending truth and justice, recalling the historical roles played by lawyers in defending the rights of Moroccans, which consolidates their position as one of the pillars of building a state of right and law. She pointed out that the project strengthens the legal framework for the profession by unifying procedures, raising the quorum to create bodies of lawyers, strengthening disciplinary powers while preserving defense immunity, as well as establishing an integrated training path that guarantees advanced scientific and professional qualification, through basic training and field training within lawyers’ offices and public institutions. In the same context, she stressed that the project enhances respect for the traditions and customs of the profession, through the obligation to wear professional uniform before judicial and disciplinary bodies, and by consolidating the values ​​framing professional practice, in a way that preserves the prestige of the profession and safeguards its position within society. He added that the project included a profound reform of the conditions for practicing the profession, by examining cases of inconsistency to protect the independence of the lawyer, and opening new horizons for practice through modern forms, such as professional civil companies, and the possibility of cooperation with foreign lawyers and law firms, in keeping with the development of economic transactions. It also highlighted the project’s strengthening of the principles of professional ethics, linking practice to the values ​​of independence, integrity and responsibility, while approving the mandatory professional civil liability insurance to protect litigants, in addition to adopting digitization within professional bodies, enhancing transparency in the management of professional paths, reorganizing the status of the trainee lawyer, and clarifying the relationship between professional bodies and judicial institutions. Al-Twizi considered that support for this project reflects a firm conviction of the Authenticity and Modernity team, stressing that the parliamentary discussion and the proposed amendments will only increase the strength and coherence of the text, and that the political alignment supporting it represents comprehensive support for the path of reforming justice and the status of defense within the state of right and law. The speaker noted that this new legislative framework is based on a vision that seeks to establish the legal profession as a free and independent profession, practiced in accordance with clear legal controls, ensuring the protection of this profession from everything that might affect its noble mission, and enhancing its ability to carry out its roles in defending the rights of litigants and preserving their dignity before the judiciary. He pointed out that the project came in the context of a comprehensive review of the current law No. 28.08, which, as he put it, has become out of step with the transformations witnessed by the justice system, and does not reflect the true position that the legal profession now occupies within the judicial system, whether at the level of guaranteeing the right to defense or consolidating the elements of a fair trial in its various dimensions. Al-Fattahi considered that the project adopts a comprehensive vision that aims to advance the profession, by enhancing the training and continuous training of lawyers, and keeping pace with national and international legislative developments related to the judiciary, in addition to establishing regulatory mechanisms that will improve the conditions of professional practice, and strengthen the relationship between the lawyer and his client on the basis of trust, clarity and mutual responsibility. In the same context, the Independent Team for Unity and Equality confirmed that it will submit a number of observations and proposals aimed at improving the legal text, including accelerating the establishment of an institute for training lawyers for the benefit of those who succeed in the competitions, and opening the way for young people within the profession to assume management and representation responsibilities by reviewing some regulatory requirements, in addition to strengthening the guarantees related to disciplinary procedures, and empowering the lawyer with the right to appeal at two levels, as well as addressing the problem of compensation related to judicial contribution tasks. Al-Fattahi concluded his intervention by emphasizing that the independence team views this project as an important reform milestone, requiring an in-depth and responsible discussion within Parliament, with the aim of reaching a balanced legal formula that guarantees the development of the legal profession, and at the same time enhances the efficiency and justice of the judicial system in general.
